In the District of Delaware, Brian’s trial win for GoDaddy made headlines and provided benchmarks for non-infringement in other patent cases involving the same patents asserted against other technology giants. In Arizona and New York, Brian’s successful patent invalidation in the USA DATA litigation was recently affirmed by the Federal Circuit and brought an end to the patent owner’s protracted licensing campaign.

In the Northern District of Georgia, Brian obtained a complete victory for Discount Tire in a bet-the-company trademark case, Discount Tire v. Mavis Discount Tire, preventing a wide swath of consumer confusion and securing an injunction covering nearly the entire Country, all to protect one of the most iconic trademarks in the country.

In the Eastern District of Texas, Brian obtained a walkaway result against a patent enforcement entity asserting a broad patent over common e-mail technology asserted against prominent retailers. In Los Angeles, he successfully represented The Hertz Corp. in a jury trial involving a significant trademark license/franchise dispute. In Arizona, he was first chair in GoDaddy v. RPost International, where the court granted summary judgment on Section 101 unpatentability regarding several patents covering email technologies. That win, which was affirmed by the Federal Circuit and was denied certiorari by the Supreme Court, mooted several similar patent cases in Texas, California, and Maryland.

Brian has achieved victories for clients through advantageous settlement and arbitration as well. In Parsons Xtreme Golf LLC v. Taylor Made Golf—where he represented PXG as plaintiff—he negotiated the successful settlement of a sprawling 23-patent suit involving novel club designs. Following a crushing dispositive motion brought on behalf of Discount Tire, he obtained a walkaway settlement against an adverse party that had obtained lucrative settlements in dozens of patent enforcement actions around the country. Brian also co-led a team that achieved an opening day of trial settlement in a technology dispute that marked one of the first jury trials during the COVID-19 Pandemic. Brian led the team for Carvana in successfully resolving a protracted trademark dispute in the Southern District of New York.

Simply put, Brian is an extraordinarily skilled courtroom lawyer who is strategic, agile, and comfortable before juries and judges in federal jurisdictions around the country.
