Ballard Spahr Attorneys Advise Kelce Brothers on Landmark Podcast Deal

A Ballard Spahr corporate transactions team represented New Heights, a company owned by Jason and Travis Kelce, in negotiating a three-year contract with Amazon’s Wondery podcast service to sell and distribute the brothers’ New Heights podcast.

Ballard Spahr also represented New Heights in the negotiation of a production agreement with Wave Sports + Entertainment (WSE), which produces and distributes original sports content for digital platforms.

Amazon announced the distribution and ad-sales deal last week. The fan-favorite podcast series features former Philadelphia Eagles Center Jason and current Kansas City Chiefs Tight End Travis, both Super Bowl champions. The deal was timed to the NFL season, which kicks off this week.

The podcast deal covers distribution rights to audio and video episodes of New Heights, in which Jason and Travis Kelce “pull back the curtain on life in the NFL with entertaining insights from a combined 24 years in the league, as well as share personal stories from their day-to-day lives,” Amazon said. New Heights will continue to be available widely on podcast services and early and ad-free on Wondery+.

The Ballard Spahr team that advised the Kelce brothers on the transaction is led by Gregory L. Seltzer, co-leader of the firm’s Emerging Companies and Venture Capital Group, who is known for structuring, negotiating, and closing corporate transactions, including in the sports and entertainment vertical market. The team included Intellectual Property Department Chair Lynn E. Rzonca, as well as Business and Transactions Department attorneys Jessica Laderman Origlio, David Goroff, and Kelly M. Duffner.
