Deepfake Ads Strain Pre-AI Campaign Laws, Puzzling U.S. Regulators

Hyper-realistic audio and visual "deepfakes" created by artificial intelligence have federal regulators struggling with how to use election laws written well before the advent of this technology to rein in misinformation. Bloomberg Law spoke to Kate A. Belinski about the situation, in particular how the Federal Election Campaign Act doesn't apply to super PACs, which may be more likely than political candidates themselves to use deepfakes.
Candidates "often will try to stay more pure and leave the dirty work to the super PACS,” she said. “It’s more likely that a super PAC or non-connected PAC would want to do some of devious deepfake anyway.”
