'Evolution' of Controversial Filter Teams Practice Underway

Filter teams, sometimes called taint or firewall teams, go through seized materials to pluck out attorney-client privileged information before it gets to prosecutors. Although they work independently of prosecutors, they still work for the government, leading white collar defense attorneys develop concerns about bias.
Celia Cohen, a former federal prosecutor, spoke to Law360 about the increasing use of filter teams and where it may head in the near future. Ms. Cohen is a member of Ballard Spahr's White Collar Defense/Internal Investigations team.
