Arizona Court: COVID-19, State Shutdown Orders No Excuse to Miss Rental Payments

The Arizona Court of Appeals recently ruled that COVID-19 shut-downs and restrictions were not valid reasons for a commercial tenant to miss rent payments. Craig Solomon Ganz, Katherine Anderson, and Mitchell Turbenson successfully represented the plaintiffs.
“This decision continues to reaffirm what we already knew: that the leases in place created a solid contractual obligation for [the defendants] to pay rent, even during the COVID-19 shutdown,” Mr. Ganz told a reporter from Law.com.
All three attorneys are members of Ballard Spahr's Litigation Department, and Mr. Ganz and Ms. Anderson are members of its Bankruptcy and Restructuring team.
