Partisan Politics and Kavanaugh's Defiant Words Put Supreme Court in Unwelcome Spotlight

The Washington Post interviewed Ballard Spahr’s Dennis Burke about the nomination of Brett Kavanaugh to the U.S. Supreme Court and the effect of partisan rancor on the Court. The scenario felt familiar to Mr. Burke, who was a Democratic counsel for the Senate Judiciary Committee during the Clarence Thomas hearings.
"People look at [the Clarence Thomas hearings] now and say this is not a functional process," said Burke. "This isn't really a proper fact-finding or a full investigation — it's just a political process."
