This workshop will discuss the challenges posed by social media platforms and practices.
Attorney Mara Gassmann, whose practice focuses on litigating and counseling news, entertainment, and other media clients in a range of matters implicating their First Amendment and intellectual property rights, and panelists will discuss the following topics:
- Litigation concerns, including preservation, authentication, and admissibility of social media posts
- The right of access to, and the right to comment on, social media sites of public officials and public figures
- Copyright concerns, including the fallout of the embedding decision in Goldman v. Breitbart News Network
