Mark Pollak has practiced for more than 30 years with a focus on the public financing of complex real estate projects and sports stadiums. He also has experience creating public-private partnerships to develop central business districts. His clients include local institutions and companies as well as national corporations and major real estate developers and investors in the mid-Atlantic area.

Representative Matters

  • Represented a leading spice and flavorings maker McCormick in negotiating the company's agreement to move its corporate headquarters to a 339,000-square-foot building on a 20-acre site in Hunt Valley, Maryland. The move from the current headquarters in nearby Sparks will enable the company to consolidate more than 900 employees who now work at several existing sites and positions the company for future growth. Ballard Spahr attorneys performed due diligence on the participating entities as well as the property, and negotiated the condominium regime and McCormick's lease.
  • Ballard Spahr represents Sagamore Development Company in the massive, 260-acre Port Covington redevelopment project in Baltimore. The project will require an investment of approximately $6.9 billion over roughly 25 years and includes an authorized $660 million tax increment financing-the largest TIF in city history, recently approved by City Council. The firm is handling all legal aspects of the project, has appeared on the company's behalf at high-profile public hearings, and helped negotiate a groundbreaking community benefits agreement with the city. The development will include a new global headquarters, residences including affordable housing, retail facilities, and extensive public amenities.
  • Ballard Spahr represents Morgan Stanley, the global financial services firm, in its expansion in a number of locations throughout the eastern United States. Our work includes assisting the client in lease negotiations as well as negotiations for tax credits and state and local incentives.
  • Ballard Spahr represents Exelon in its large, complex leasing transaction through which the leading national energy provider will establish its new division headquarters in the signature Harbor Point mixed-use development between Inner Harbor and Fells Point in Baltimore. The 20-story tower is being built by Beatty Development Group and will also include 103 apartments, 40,000 square feet of retail space, and a parking garage. As the new hub of a major division of Exelon, a Fortune 100 company, the LEED Gold offices will be home to a massive, 24-hour trading floor. Ballard Spahr handled numerous lease issues including environmental indemnity and pollution legal liability (PLL), and construction contracting.
  • Assisted real estate developers in development activities throughout downtown Baltimore, including Centerpoint and the Westside Superblock.
  • Represented a major NFL franchise in the land acquisition, development, and financing of its $250 million football stadium project in the Washington, D.C., area.
  • Served as counsel to the entity that established the Cadillac Grand Prix of Washington, D.C.
