Claire Ana-Perot Tracey focuses her practice in the areas of real estate, construction litigation, commercial litigation, and mortgage banking.
Ms. Tracey regularly represents mortgage lenders and servicers in commercial and residential foreclosures, receivership actions, tax sales, actions for sale in lieu of partition, estates in probate, and nuisance claims. In her real estate and construction litigation practice, she regularly represents real estate developers, public and private corporations, insurance companies, housing authorities, nonprofit organizations, and individuals in multi-party litigation, mediation, and arbitration. She has experience in construction defect litigation, surety litigation, complex contract disputes, payment and performance bond claims, and mechanics lien claims.
Ms. Tracey also defends clients against discrimination complaints from the Equal Employment Opportunity Commission, the U.S. Department of Housing and Urban Development, and state and local human rights agencies. She counsels clients on compliance with federal accessibility laws, including the Americans with Disabilities Act, the Fair Housing Act, and Section 504 of the Rehabilitation Act, as well as their state or local counterparts.
Ms. Tracey is a former associate general counsel for the Maryland-National Capital Park and Planning Commission, serving on its litigation and employment team and representing its interests and those of its employees in state and federal district courts, state circuit and appellate courts, and administrative hearings, including workers' compensation and unemployment insurance appeals.
Pro Bono Experience
As a student attorney for the University of Maryland School of Law Clinical Office, Ms. Tracey advocated for the rights of ex-offenders re-entering the community by providing needed legal assistance, including advice on expungement and child custody/visitation. She also worked with local lobbyists to support a related bill and prepared testimony for the bill.
